TIPO Amending Regulations for TPP

The 12 member countries of TPP (Trans-Pacific Partnership) have signed the TPP agreement on February 4th, 2016. If all the member countries finish the approval procedure and make the notification to the TPP agreement keeping institution (New Zealand Government) in 2 years since the agreement is signed, TPP would be in effect in 60 days since all the notifications have been made. If a part of the member countries do not make notification to the agreement keeping institution, while over 6 member countries, including the U.S. and Japan, finish the notification procedure, TPP will be in effect in April, 2018.

In coordination with the policies of The Executive Yuan for joining TPP, TIPO conducts certain regulation amending process:

  1. Patent Law: enlarging the period of grace and the compensation for unreasonable delay caused by patent authority;
  2. Trademark Law: imposing criminal punishment upon counterfeiting imported labels and packages;
  3. Copyright Act: endowing the performer of a sound record with the right for public broadcast; extending the copyright to fifty years after the author's death; imposing criminal punishment upon circumventing technical protection; applying ex officio prosecution to certain criminal behavior.
